DEPARTMENT OVERVIEW

The Equity & Equal Protection Office is responsible for the administration of UCSC's policies and procedures regarding Title IX, discrimination and harassment on the basis of race, religion, disability, sex, gender, age and other protected identities. Our work includes stewarding complaint processes for students, staff, and faculty who have experienced discrimination and ensuring that members of our community can engage in protected activity free from retaliation. We are responsible for the University's compliance with state and federal laws relating to discrimination to ensure that no member of our community is denied participation in an academic program or employment based upon a protected identity or engaging in protected activity. The Title IX office facilitates alternative resolutions and conducts formal investigations of complaints and reports filed by students, employees, and the public.

JOB SUMMARY

Under general direction, the incumbent ensures compliance with Federal Title IX regulations and University policies, and serves as a campus resource person for matters pertaining to the Violence Against Women Act (VAWA) and Title IX. The Deputy Title IX Officer facilitates the resolution of discrimination, sexual harassment and sexual violence complaints of faculty, staff and students and others who engage with the University; conducts research and legal analyses on relevant laws and regulations; develops local policies and guidelines; and oversees the training programs designed to educate the University community on discrimination, sexual harassment and sexual violence prevention and mandated reporting.

APPOINTMENT INFORMATION

Budgeted Salary: $130,000 - $170,000/annually. Salary commensurate with skills, qualifications and experience.
Under California law, the University of California, Santa Cruz is required to post a reasonable estimate of the compensation for this role. The salary shown above is the budgeted amount the University reasonably expects to pay and the salary extended should not exceed this posted amount.

JOB DUTIES

50% - COMPLIANCE
  • Participates with high level management in strategic thinking and planning in regards to ethics and compliance policy. Develops benchmarks/training for complex topics. Represents the organization to external agencies. Manages external inquiries.
  • Identifies compliance issues of importance to the organization which frequently cross organizational lines. Collaborates with the Title IX Director to develop appropriate analytical and procedural framework for addressing the issues in the organization.
  • Remains knowledgeable of current state and federal law, regulations, and trends in the field of education related to harassment and other discriminatory practices, including those that violate Title IX.
  • Maintains current inventory of regulations and statutes relating to sex, gender based violence including, but not limited to, Title VI, Title VII, Title IX, VAWA, Campus Save Act, Clery Act and any new legislation on the subject.
  • Assists in maintaining requested statistics and data for reporting purposes, specifically using EEP database and management systems.
  • Ensures organization has appropriate critical coordinated response systems with effective and efficient controls in place. Confirms organization compliance with legal and regulatory requirements in a complex changing environment. Provides cross functional coordination for risk mitigation
  • Develops proposals and recommendations to guide and support a broader strategic direction for EEP and the Title IX program.
  • Works with campus offices and other UC's to build a coordinated system-wide approach to comply with relevant policy, including Title IX.

35% - CASE MANAGEMENT
  • Conducts assessments of initial complaints of harassment and discrimination (including sexual misconduct) to determine the merit of complaints; interviews the impacted party, gathers relevant information, advises impacted parties of their rights and options. Maintains a high level of confidentiality and ensures appropriate documentation.
  • Implements supportive, interim, and remedial measures as appropriate and makes appropriate referral to Case Resolution Officers/Civil Rights Investigators for case management and complaint resolution.
  • Provides consultation and determines avenues for resolution, assesses potential liability, and advises managers and supervisors on appropriate corrective and remedial action.
  • Collaborates and consults with the Title IX Director regularly to monitor and manage incident reports to ensure an efficient and effective response to reported incidents.
  • Provides periodic, timely updates regarding the status of complaints received and investigations in progress to the Title IX Director.
  • Provides guidance, support, and oversight to team members and investigators to ensure thorough and timely investigations. Ensures comprehensive written investigative reports that clearly identify the issues investigated, summarizes the evidence, correlates findings to University policy, and recommends appropriate remedial steps. Reviews investigation plans including timelines.
  • Ensures accurate and thorough records and notes to ensure a well-documented investigatory process.
  • Leads task forces to respond to the highest profile complaint cases and/or those with significant potential impact to the organization. Advises on issues without precedence. Provides industry benchmarks.
  • Ensures management corrective actions are in place following complex and or politically sensitive investigations. Confirms appropriate monitoring controls are utilized. Responsible for the most sensitive of investigation subjects.
  • Provides consultation and information regarding Title IX and VAWA (Violence Against Women Act) requirements to all involved parties.

10% - TRAINING AND OUTREACH
  • Develops and implements training programs on compliance policies and procedures under the purview of EEP and diversity/inclusion related topics, as needed and as time allows.
  • Collaborates with the Title IX Director and EEP staff, as well as other campus managers, to assess EEP's educational and training needs for specific units and the campus as a whole.
  • Contributes content to campus Title IX training, working closely with the Assistant Director of Education, Prevention & Training and other EEP staff, Systemwide Title IX Office staff, Staff Human Resources, Academic Personnel Office and others as appropriate.

5% - SPECIAL PROJECTS
  • Performs other duties and special projects as assigned.


REQUIRED QUALIFICATIONS
  • Bachelor's degree in related area and / or equivalent experience and / or training
  • Experience investigating sexual harassment or other equivalently sensitive allegations in an empathetic and confidential manner.
  • Expert knowledge of the ethics and compliance profession, theories and systems of internal control and professional compliance and investigations standards.
  • Expert knowledge of the complexities of sexual harassment, including sexual violence, in the postsecondary setting.
  • Expert knowledge of ethics and compliance policies, procedures and programs in a university setting. Demonstrated grasp of ROI (Return on Investment) concepts. Ability to apply policy and legal concepts to issues.
  • Expert knowledge of federal and state laws and regulations, case law, and guidance related to sexual harassment in the educational and employment setting, including Title IX of the Education Amendments of 1972, Violence Against Women Act (VAWA), and California (CA) AB1825 and SB 1343. Expert knowledge of how to respond to requests from the Office for Civil Rights, CA Department of Fair Employment and Housing, and the U.S. Equal Employment Opportunities Commission.
  • Expert knowledge of best practices and methodologies for conducting investigations, including creating a case plan, interviewing, gathering and analyzing evidence, and writing investigation reports.
  • Applies sound principles and standards in completing highly complex and technical assignments.
  • Excellent interpersonal skills to work independently with all levels of University personnel, including management and faculty, and to facilitate agreement on issues and corrective actions.
  • Excellent skills in complex decision making on critical issues.

PREFERRED QUALIFICATIONS
  • Leadership expertise and political acumen overseeing sensitive complaint resolutions within a large, complex organization.
  • Bilingual language skills in Spanish or other language covered by institutional Title VI plans.
  • Thorough knowledge of the Clery Act. Experience with Clery reporting.
  • Thorough knowledge of Whistleblower and Whistleblower Retaliation laws.
